Terms of Service for SmartFridge

1. Agreement to Terms
By downloading, installing, or using the SmartFridge mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legally binding agreement between you ("User" or "you") and SmartFridge ("Company," "we," "us," or "our").
2. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by:
- Updating the "Last Updated" date
- Posting notice in the App
- Sending an in-app notification
Your continued use of the App after changes constitutes acceptance of the modified Terms.
3. Description of Service
SmartFridge is a food inventory management application that helps users:
- Track food items and expiration dates
- Receive expiration reminders
- Reduce food waste
- Scan receipts using OCR technology (Premium)
- Get recipe suggestions (Premium)
- Manage shopping lists (Premium)
- View environmental impact analytics (Premium)
3.1 Free Version
The free version includes:
- Track up to 50 food items
- Basic expiration notifications
- Manual item entry
- Basic analytics
3.2 Premium Subscription
Premium subscribers receive:
- Unlimited food items
- Receipt scanning with OCR
- Advanced analytics and environmental impact dashboard
- Recipe suggestions based on expiring ingredients
- Shopping list functionality
- Barcode scanner
- Data export capabilities
- Custom expiration reminders
- Priority customer support
4. Subscription Terms
4.1 Pricing and Payment
- Monthly Subscription: Billed monthly at the current rate
- Yearly Subscription: Billed annually at the current rate
- Prices may vary by region and are displayed in the App
- Payment is charged to your Apple ID account
- All payments are processed through Apple's App Store
4.2 Auto-Renewal
- Subscriptions automatically renew unless canceled
- Your account will be charged for renewal within 24 hours before the current period ends
- You can manage subscriptions and turn off auto-renewal in your Apple ID Account Settings
- Cancellation takes effect at the end of the current billing period
4.3 Free Trials
- We may offer free trial periods for new subscribers
- You will be charged when the trial period ends unless you cancel before then
- Cancel anytime during the trial to avoid charges
- One trial per user/household
4.4 Refund Policy
- All sales are final and processed through Apple
- Refund requests must be made through the App Store
- We do not have access to process refunds directly
- Contact Apple Support for refund inquiries
- Refunds are subject to Apple's policies
5. User Accounts and Data
5.1 No Account Required
- SmartFridge does not require account creation
- All data is stored locally on your device
- No personal information is required to use the App
5.2 Your Data
- You own all data you enter into the App
- You are responsible for backing up your data
- We are not liable for data loss
- Premium users can export data as CSV
6. Acceptable Use
6.1 Permitted Use
You may use SmartFridge for:
- Personal, non-commercial food tracking
- Household inventory management
- Reducing personal food waste
6.2 Prohibited Use
You may NOT:
- Use the App for commercial purposes without permission
- Reverse engineer, decompile, or disassemble the App
- Copy, modify, or create derivative works
- Remove copyright or proprietary notices
- Use automated systems (bots, scrapers) with the App
- Attempt to gain unauthorized access
- Interfere with or disrupt the App's functionality
- Violate any applicable laws or regulations
- Share Premium features with non-subscribers
7. Intellectual Property
SmartFridge and all related content, features, and functionality are owned by the Company and protected by copyright, trademark, patent, and other intellectual property laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for personal, non-commercial purposes.
8. Third-Party Services
8.1 Apple Services
- The App uses Apple's App Store, StoreKit, and potentially iCloud
- Your use of Apple services is governed by Apple's Terms and Conditions
- We are not responsible for Apple's services or policies
8.2 OCR and Vision Framework
- Receipt scanning uses Apple's Vision framework
- Processing is done on-device
- We are not responsible for OCR accuracy
- Results may vary based on image quality
9. Disclaimers
9.1 Food Safety
IMPORTANT: SmartFridge is a tracking tool only. We do NOT:
- Provide food safety advice
- Guarantee food freshness or safety
- Verify expiration dates
- Replace professional food safety guidance
Always use your judgment regarding food safety. When in doubt, throw it out.
9.2 "As Is" Service
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING:
- Merchantability
- Fitness for a particular purpose
- Non-infringement
- Accuracy or reliability
- Uninterrupted or error-free operation
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
10.1 No Liability
We are NOT liable for:
- Food poisoning or illness
- Data loss or corruption
- Financial losses from food waste
- Indirect, incidental, or consequential damages
- Lost profits or revenue
- Service interruptions
10.2 Maximum Liability
Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim, or $100, whichever is less.
11. Apple-Specific Terms
As required by Apple:
- These Terms are between you and SmartFridge, not Apple
- Apple is not responsible for the App or its content
- Apple has no obligation to provide support
- License is limited to a non-transferable right to use the App on Apple-branded products you own
- Subject to the Usage Rules in Apple's App Store Terms of Service
- Apple and its subsidiaries are third-party beneficiaries with the right to enforce these Terms
12. Governing Law
These Terms are governed by the laws of the United States, without regard to conflict of law principles.
